The property dispute group at Field Seymour Parkes combines the expertise and experience of lawyers from land law and dispute resolution backgrounds. Property disputes are an unfortunate fact of life often giving rise to complex legal issues. Our specialist group has the breadth of experience and the technical know-how to advise effectively on the most difficult of problems. The type of work undertaken by the group is wide-ranging and covers both commercial and residential property. In the field of commercial property, the group will typically advise on rent arrears, service charge disputes, dilapidations and general tenant default (often involving insolvency and/or forfeiture proceedings). The group’s work in relation to residential property covers disputes relating to easements (rights of way, rights of drainage etc), restrictive covenants and boundaries. We also advise on matters involving adverse possession. Another important area of work undertaken by the group concerns disputes relating to residential tenancy agreements.
