Breach of Finance Lease Documents
Acting for a large fleet-hirer of motor vehicles who supplied circa 150 vehicles to a third party company on various different finance agreements e.g. conditional sale and hire purchase. The hiree breached its contractual obligations. Various legal actions followed including injunctions and a search and seizure order.
Commercial Agency Dispute
Advising a manufacturer client on a dispute with a commercial agent responsible for selling its vehicles to a market sector overseas.
Product Liability Disputes
Advising clients on a number of product liability disputes from property damage caused by fire to claims regarding the design of a vehicle.
Defending a number of claims brought against dealerships in respect of a variety of matters such as vehicles not being fit for purpose/ of satisfactory quality.
Successfully defending a significant claim brought against a vehicle manufacturer for an alleged misrepresentation regarding its fuel consumption data.
Conversion Claim – Sale of Goods
Acting for a bespoke vehicle hire company in an action to trace and recover a bespoke TVR Tuscan sold by the hiree in breach of the covenants in their finance agreement. Issuing proceedings for damages against the Defendants for conversion and breach of the agreement.
