Trade marks: How can you defend your business?

Trade marks are one of the greatest assets of any business. Words, phrases, logos, colours and packaging act as crucial components of your brand, helping customers recognise your product or service, and distinguishing you from your competitors.

This webinar provides a practical insight into how your business can seek to protect itself from infringement of your registered and unregistered trade marks, and what to do if it they are infringed. With a particular focus on protecting the names, logos and phrases that make your business unique, it will focus on:

1. What protections can you put in place to prevent or reduce the risk of infringement?

2. What to consider if there is a potential infringement

3. What can you do if the worst happens
a. What are the legal tests and evidential requirements to prove an infringement?
b. Legal causes of action if an infringement has occurred:
i. If you have a registered trade mark, a claim for trade mark infringement
ii. Where there is no registered trade mark, a claim for passing off

c. Potential remedies the court will grant
i. Urgent/interim remedies
ii. Damages
iii. Final injunctions

d. Other factors to consider, including the practicalities and realities of embarking on litigation
