Disputes can be uncertain, time-consuming and slow-moving. Costs can quickly escalate. At FSP we aim to give you a clear idea of where you stand right from the start and to then try to find the best solution for your particular issues.

We have very high level litigation and arbitration expertise and often find ourselves up against City or international firms. A particular skill is our ability to deal with complex, technical litigation in a cost-effective and pragmatic way.

As well as court or arbitration proceedings, we advise on regulatory or other corporate investigations. We deal with risk management and can give guidance to businesses on how to manage a distressed contract or project. We also have extensive experience of bringing or defending construction and other claims through adjudication.

We aim to give clients a clear idea of where they stand as early as possible. We look for solutions to a dispute.

To help us do this, we use innovative tools like costs budgets and decisions trees.

Costs budgets break legal spend down so we can explore staging and possible cost saving with you. We are always willing to discuss flexible cost arrangements – blended rates, fixed or capped fees, conditional fee arrangements, insurance products, clients doing some of the work themselves.

Decision trees allow us to map out a dispute with a client and set out outcomes and options. We are currently the only law firm in the Thames Valley and one of the few firms in the UK using decision trees.

  • Acting for an LLP in respect of a multi million pound professional negligence claim for damages against its auditors arising out of a failed tax mitigation strategy
  • Advising a seller on a multi-million pound earnout and warranty dispute
  • Advising on a dispute relating to good leaver / bad leaver status and implications for shares held in the former employing company
  • Acting for the former shareholders of a large consultancy business in respect of a £5m breach of warranty claim brought against them following the sale of its business.  Considering s.994 issues of unfair prejudice
  • Successfully defended a claim made against a global manufacturer client under the Consumer Protection Act 1987 involving issues relating to the service of proceedings out of the jurisdiction, substitution of parties after the statutory limitation period, and the exercise of the court’s discretion considering factors such as delay, prejudice, and compliance with the Civil Procedure Rules
  • Labrouche v Frey: a reported case involving a multi-million pound international private trust dispute involving parallel proceedings overseas. The judgement ruled on a variety of issues including the nature of a trustee’s duty to account, the correct approach to drawing inferences from historical events and defences for trustees who act honestly and reasonably
  • Advising on a construction dispute over a terminal building at a major international airport
  • Acting in one of the very first arbitrations before the Groceries Code Adjudicator under the GSCOP rules
  • Acting in a number of Judicial Review and Public Procurement Challenges.
