Data protection is one of the most important areas of legal compliance for many of our clients, particularly since the introduction of the GDPR back in 2018 brought made major changes to the privacy landscape.

The fast pace of technology change – including the challenges brought by AI/machine learning – combined with ever-increasing volumes of personal data being shared mean this is an area which businesses need to keep under regular review, for example to ensure that they adhere to data minimisation and transparency principles.

The UK’s departure from the European Union and the large amount of change around international data transfers mean that there are a lot of rules which organisations need to keep abreast with.

Our team regularly advises on all aspects of data protection compliance, providing pragmatic advice on matters ranging from DPIAs and transfer risk assessments to annual data audits, subject access requests, ICO complaints and investigations. We review and prepare all types of documentation including privacy policies and notices, cookies policies, data processing agreements, agreements for international data transfers and more.

Our team of specialist lawyers has expertise in the following:

  • Undertaking data protection training workshops and audits and updating documentation many clients as part of their ongoing GDPR compliance.
  • Providing detailed advice on data exporting issues for various clients, including helping with transfer risk assessments and putting in place data processing agreements which incorporate the UK IDTA published by the ICO or the EU standard contractual clauses (SCCs). For example, supporting one particular client which provides technology-enabled energy solutions on data protection and data transfer issues arising from the post-acquisition migration of their data to the US, including supporting them when this issue impacted negotiations with some of their major customers.
  • Guiding clients with ongoing privacy issues such as responding to DSARs and responding to related correspondence.
  • Providing advice on how to deal with data breaches, making reports to the ICO and notifying data subjects.
  • Updating the terms of service and privacy policy for a client offering an AI-based ’emotionally intelligent’ service.
